    The Delhi High Court on Wednesday questioned Flipkart on whether its “more sellers” or latching-on feature can be considered legitimate when, in the facts of the case, it is alleged to enable the sale of counterfeit goods linked to a genuine product listing.

    Justice Jyoti Singh raised the issue while hearing a suit filed by a seller alleging that counterfeit sellers had latched on to its product listing as “more sellers” and offered non-genuine goods at lower prices, thereby misleading consumers.

    During the hearing, Flipkart's counsel submitted that the latching-on feature permits multiple sellers offering the same product to be linked to a single listing.

    In response, Justice Singh orally asked, “Is it legitimate?” and further queried, “Which judgment has legitimized this?

    The counsel maintained that the feature was “purely legitimate” and was intended “for the benefit of buyers and sellers.

    The Court, however, orally observed that the feature appeared “so open to abuse” and remarked that “customers are also duped.”

    Justice Singh further noted that from the perspective of the original trademark holder, there was evident harm, as “the customer does not know whether it is a counterfeit,” particularly when significantly lower prices were displayed alongside the genuine product.

    Explaining the seller's grievance, counsel pointed out that while the plaintiff had created the original product listing, other sellers were allowed to latch on as “more sellers” and offer goods at lower prices, which were allegedly not genuine.

    It was argued that this was not a case of legitimate resale of the same product.

    Flipkart's counsel sought to justify the feature by explaining that it was designed to avoid multiple listings for identical products. He also said that the customer could view different sellers offering the same product at varying prices.

    When the Court asked whether customers could actually distinguish genuine products from counterfeits in such a setup, Justice Singh reiterated her concern that the feature was predominantly open to misuse.

    The court ultimately issued notice to Flipkart and directed it to file its reply within two weeks. Flipkart was also asked to place on record its policy governing the latching-on feature, along with judgments relied upon in support of its legality.

    The matter will next be listed on February 19, 2026.
